Elon Musk testified in federal court that his artificial intelligence startup xAI used model distillation from OpenAI to help train the Grok chatbot. The admission occurred on Thursday during the third day of a trial in Oakland, where Musk is suing OpenAI executives Sam Altman and Greg Brockman. When asked directly by OpenAI lead counsel William Savitt if xAI distilled OpenAI technology, Musk stated that it did so “partly” to validate its own systems.
Technical Implementation and Licensing Conflict
Model distillation involves using a larger, more powerful teacher model to generate data that trains a smaller, more efficient student model. Musk defended this as a standard industry practice used to validate and benchmark one’s own model against competitors.
This practice directly conflicts with OpenAI’s terms of service, which prohibit developers from using model outputs to train competing artificial intelligence systems. Earlier in 2026, OpenAI and Anthropic accused several firms, including the Chinese startup DeepSeek, of executing industrial-scale distillation attacks. In those incidents, Anthropic identified roughly 16 million exchanges and 24,000 fraudulent accounts used to extract training data. As open models drive derivative growth across the ecosystem, tracking the provenance of synthetic training data has become a central legal and technical challenge.
Financial Damages and Trial Scope
The trial, presided over by Judge Yvonne Gonzalez Rogers, centers on Musk’s claim that OpenAI’s transition to a for-profit structure constitutes a breach of charitable trust. Musk is seeking between $134 billion and $150 billion in damages, which he intends to return to OpenAI’s original nonprofit mission.
Court proceedings confirmed that Musk donated approximately $38 million to OpenAI before his departure in 2018. The financial scale of the dispute reflects massive shifts in private market capitalization. OpenAI is currently valued at $157 billion, with some court estimates projecting up to $730 billion based on future revenue, while xAI recently closed a $6 billion funding round.
The trial is expected to last four weeks. Following Musk’s testimony, the scheduled witness list includes OpenAI CEO Sam Altman, Microsoft CEO Satya Nadella, and AI safety expert Stuart Russell.
